How do I obtain a marriage license in Illinois? The procedures are the same for all couples. Same-sex couples may apply for a marriage license as of June 1, 2014. A marriage license becomes effective 24 hours after application. Applications are available from any county clerk’s office, and both parties must be present to apply. Same-sex spouses will receive the same rights and responsibilities afforded to different-sex spouses under Illinois law, including health care decision-making, property and inheritance rights. What do I have to do if I'm an Illinois resident who is legally married in another jurisdiction? You do not have to get married in Illinois or otherwise register your marriage in Illinois. Illinois’ marriage equality law recognizes as valid lawful marriages between same-sex couples from other jurisdictions. What does the law mean if I have entered into a civil union with my partner in Illinois? Civil unions will not automatically convert to marriages. Those who wish to convert their civil unions to marriages will have two options. The couple may apply for a marriage license and have a marriage ceremony to convert their civil union into a marriage without a fee. Alternatively, during the first year after the marriage law goes into effect, the couple may apply to a county clerk for a marriage certificate that will show them as married as of the date they entered their civil union, sign the certificate, and return it, also without a fee. To receive the federal rights, benefits, and responsibilities of marriage, a couple must enter into a marriage or convert their civil union to a marriage.
